Client: Aggregate Industries
Aggregate Industries have operated this sand & gravel pit in Devon for the best part of 30 years. It had planning permission for twenty more years but the site had recently been designated as being of European importance for its ecology and wildlife.
The Department for the Environment, Food & Rural Affairs required Devon County Council to modify the planning permission so as to protect the new status of the land. The effect of this was to prevent the extraction of virtually all of the mineral.
Aggregate Industries came to Gerald Eve and our team, bringing their detailed understanding of the quarrying industry to bear, examined the case thoroughly. It was clear to us that the company would be entitled to substantial compensation and we put in a claim which was agreed after negotiation. The compensation was paid by Devon County Council, which was reimbursed by The Department for the Environment, Food & Rural Affairs.
