Gerald Eve was instructed to represent a national building society in respect of a significant dilapidations claim, which their landlord had served under the terms of their lease.
The tenant occupied the ground floor and basement of the premises and was looking to surrender the first to third floors to the landlord. The lease terms were fully repairing and insuring for the whole of the property.
The landlord’s surveyors had inspected the premises and put together a Schedule of Dilapidations with a total claim of approximately £265,000.
Through applying our working knowledge of dilapidations law and through careful negotiations with the Landlords and their surveyors we were able to agree a settlement figure of 60% less than the Landlord’s original claim.
