Client: Solihull NHS Care Trust


The Solihull NHS Care Trust occupied approximately 15,000 sq.ft. of offices in a large 1960’s office building in the centre of Solihull. The premises were located on three separate floors and were subject to three separate leases but with contemporaneous lease expiries.

The leases duly expired and the Solihull NHS Care Trust vacated the premises, in part due to reorganisation.

The landlord of the premises formally served upon Solihull NHS Care Trust a Terminal Dilapidation Claim of £148,500.  Solihull NHS Care Trust instructed Gerald Eve LLP to assist and advise in the matter of the Terminal Dilapidation Claim.

Approach
Gerald Eve LLP reviewed all the legal documents relating to the former leasehold interest and made a detailed inspection of the premises.  With careful reference to the leasehold obligations and responsibilities formal negotiations were entered into with the landlord’s professional representatives.

Results
Gerald Eve LLP brokered a full and final settlement of all the Trust’s accrued dilapidation and leasehold liabilities at a sum of £17,800.  This represented a substantial saving on the landlord’s initial claim of £148,500.
