The South Somerset NHS Primary Care Trust occupied approximately 8,000 sq.ft. of offices in a large circa 1995 office building in Chard Somerset. The premises were located on the ground floor and were subject to standard institutional FRI lease which had expired.

The landlord of the premises formally served upon South Somerset NHS Primary Care Trust a Terminal Dilapidation Claim of £130,797. South Somerset NHS Primary Care Trust instructed Gerald Eve LLP to assist and advise in the matter of the Terminal Dilapidation Claim.

Approach
Gerald Eve LLP reviewed all the legal documents relating to the former leasehold interest and made a detailed inspection of the premises. With careful reference to the leasehold obligations and responsibilities formal negotiations were entered into with the landlord’s professional representatives.

Results
Gerald Eve LLP brokered a full and final settlement of all the Trust’s accrued dilapidation and leasehold liabilities at a sum of £30,000. This represented a substantial saving on the landlord’s initial claim of £100,797.
