Malcolm is a Partner in our Lease Consultancy team with a principal focus on central London offices. His core expertise includes rent reviews, lease renegotiation and dispute resolution. Malcolm advises clients how to avoid or resolve the pitfalls involved in commercial property leasing, handling negotiations between existing landlords and tenants. He is experienced at restructuring leases, ground lease negotiations and leading asset management initiatives.

Malcolm is an experienced expert witness, providing written evidence for arbitrators, independent experts and the court. He has given oral evidence in both the High Court and Central London County Court. He has the RICS/Edexcel expert witness qualification.

Malcolm has over twenty years’ experience in lease consultancy as a Partner of Drivers Jonas, Deloitte and now Gerald Eve.  His principal clients include the City of London Corporation, Global Holdings Management, London local authorities, Network Rail, the UK government and University College London.

Specific experience

Office Rent Review Negotiations
Malcolm has particular experience in the Midtown, including Kings Cross and Southbank.  He has achieved record results in recent rent review settlements in Bloomsbury and Pentonville Road.  He has considerable knowledge of rent review law and practice and is skilled at planning and executing negotiation strategies which include multiple tenancies.

Ground Leases
He is experienced at advising on all aspects of ground leases, including rent reviews, rent reconciliations and restructuring. Malcolm is adept at exploiting opportunities for clients to enhance income and asset value.  Advising Network Rail he agreed terms for the restructuring of the ground lease of the former Vinopolis at Stoney Street SE1 to facilitate redevelopment of new 200,000 sq. ft. office & retail scheme.

Expert Witness
Malcolm acted as an Expert in several rent review arbitrations and on high profile court cases. These include acting for the Ministry of Justice on a £40m rent review and lease restructuring dispute in Holborn and for the City of London Corporation on 50 lease renewals at Smithfield Market.
